Special Reports
As part of its work to promote awareness of and advocacy on free expression issues, CJFE has released reports on topics such as the state of press freedom internationally and Internet censorship.
2009
- Grant v Toronto Star Factum of Intervenors
A second case involving the key new defence of "public interest responsible journalism" will be heard before the Supreme Court of Canada on Thursday, April 23. We
hope through our intervention that there will be an increased recognition of the value of free expression in matters of public interest. As our lawyer,
Brian Rogers will state in our arguments "No matter the importance of the subject-matter or the efforts made to get it right, the only [current] defence in such circumstances is truth. This
puts the onus squarely on defendants to prove the defamatory meaning true through admissible evidence at trial. Further, falling short of that mark can serve as evidence of malice and give
rise to aggravated and even punitive damages. All these risks are on the defendants."
- Webcast Cusson v Quan case
This defamation case heard before the Supreme Court of Canada on February 17, 2009, hoped to uphold a new defence of "public interest responsible journalism" ("PIRJ"). This defence protects
statements of fact, as well as opinion, even when evidence isn't available to prove them true in court. This appeal, which CJFE intervened on, would ensure that this defence will be made available
across Canada.
- The Case of Amir Attaran
This access to information case involved Ottawa professor Amir Attaran who had attempted to get access to Canadian Department of Foreign Affairs reports on human rights in Afghanistan. On April 5,
2009, we learned that the case, in which CJFE was an intervenor, was unsuccessful. To view our press release about the case click here
